1. Introduction
Welcome to Belaya Belaya Tour Agency. These Terms of Service ("Terms") govern your use of the Belaya Belaya Tour Agency website (belaya-belaya.com) and services offered by Belaya Belaya Tour Agency ("we," "our," or "us").
By accessing our website, making a booking, or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.
2. Booking and Payment
2.1 Booking Confirmation
Your booking is confirmed only when you receive a written confirmation from us, usually by email, and after we have received your deposit or full payment (as applicable).
2.2 Pricing
All prices are quoted in Australian Dollars (AUD) and include applicable taxes unless otherwise stated. Prices are subject to change until your booking is confirmed.
2.3 Payment
For most tours, a deposit of 25% of the total tour price is required at the time of booking, with the remaining balance due 60 days before the tour start date. For bookings made within 60 days of the departure date, full payment is required at the time of booking.
Payment can be made by credit card, bank transfer, or other methods as specified during the booking process. All credit card payments may be subject to a processing fee.
2.4 Special Requirements
Any special requirements (dietary, medical, etc.) must be communicated to us at the time of booking. While we will make reasonable efforts to accommodate these requirements, we cannot guarantee that all requests can be met.
3. Cancellation and Changes
3.1 Cancellation by You
Cancellation of a confirmed booking must be made in writing. The following cancellation fees apply:
- More than 60 days before departure: Loss of deposit
- 59-30 days before departure: 50% of total tour cost
- 29-15 days before departure: 75% of total tour cost
- 14 days or less before departure: 100% of total tour cost
We strongly recommend that you purchase comprehensive travel insurance to cover cancellation fees.
3.2 Changes by You
If you wish to make changes to your booking after confirmation, we will make reasonable efforts to accommodate your request, but cannot guarantee that changes will be possible. A fee of AUD 100 per person may apply to each change, in addition to any difference in tour price.
3.3 Cancellation or Changes by Us
We reserve the right to cancel or change any tour before departure for any reason, including insufficient participation or force majeure events. In such cases, you may choose between:
- Accepting the change or an alternative tour (with price adjustment if applicable)
- Receiving a full refund of all monies paid
We are not responsible for any incidental expenses you may have incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.
4. Travel Documentation and Requirements
4.1 Passports and Visas
It is your responsibility to ensure you have a valid passport with at least six months validity beyond your return date, as well as any necessary visas or permits for all countries visited during your tour.
4.2 Health Requirements
It is your responsibility to ensure you are aware of any health requirements or recommendations for the destinations you are visiting and to take appropriate medical advice.
4.3 Travel Insurance
Comprehensive travel insurance is highly recommended for all travelers. Your policy should cover trip cancellation, medical emergencies, evacuation, repatriation, and loss or damage to personal belongings.
5. During Your Tour
5.1 Tour Leaders and Local Guides
Our tour leaders and local guides have authority to make decisions related to the tour, including modifications to the itinerary if necessary for safety, comfort, or enhanced experience.
5.2 Behavior
You agree to behave in a respectful manner toward fellow travelers, our staff, and local people. We reserve the right to terminate your participation in a tour if your behavior is deemed inappropriate, disruptive, or illegal, with no refund provided.
5.3 Changes to Itinerary
While we strive to operate tours as described, it may be necessary to modify itineraries due to local conditions, weather, transport delays, or other unforeseen circumstances. No refunds will be given for reasonable itinerary changes.
5.4 Accommodation
Accommodations are as described in the tour details. We reserve the right to substitute accommodations of a similar standard if necessary.
6. Limitation of Liability
To the extent permitted by law, we exclude all liability for any loss or damage whatsoever (including but not limited to physical injury, emotional distress, or property loss) arising from or related to your participation in our tours.
We act as an agent for transportation companies, hotels, and other service providers and are not liable for any injury, damage, loss, accident, delay, or irregularity arising from these services.
In particular, we are not liable for:
- Acts or omissions by third party service providers
- Illness, theft, or injury
- Schedule changes or cancellations
- Natural disasters, weather conditions, or civil unrest
- Any event beyond our reasonable control
Our liability is limited to the cost of the tour booked with us. Nothing in these Terms seeks to limit liability for death or personal injury caused by our negligence.
7. Image and Likeness
You grant us permission to use photographs or videos taken of you during the tour for promotional purposes without compensation to you. If you prefer not to be photographed or recorded, please inform your tour leader.
8. Website Use
8.1 Intellectual Property
All content on our website, including text, graphics, logos, and software, is our property or that of our content providers and is protected by Australian and international copyright laws.
8.2 Accuracy of Information
While we make reasonable efforts to ensure the accuracy of information on our website, we cannot guarantee that all information is complete, accurate, or up-to-date.
8.3 Links to Third-Party Websites
Our website may contain links to third-party websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites.
